Requirements for SMS/Text Messaging Campaigns

 

To conduct SMS/text messaging campaigns, High Plains Power must:

  1. Collect Consent: Obtain consent from participants before sending text messages. Offer an opt-in option for text message communications.
  2. Describe Content: At the time of consent, explain the types of content/communications they will receive. For example, “Receive account notifications via SMS from High Plains Power.”
  3. Disclose Fees: Inform recipients that they may incur fees for receiving SMS messages. A typical message might state, “Message and data rates apply.”
  4. Notify Frequency: Let recipients know how often they will receive messages. Use phrases like “4 messages per month” or “Message frequency varies.”
  5. Opt-Out Option: Provide a way for recipients to opt out of future messages. Include instructions such as, “Text STOP to cancel.”
  6. Provide Assistance: Offer a means for recipients to get help. This can be through additional SMS messaging, a phone number, or an email address. Examples include, “Text HELP for help” or “Call 307-856-9426 for assistance.”
  7. Link to Terms of Service: Include a link to the High Plains Power Text Messaging Terms of Service.
  8. Link to Privacy Policy: Include a link to the High Plains Power Text Messaging Privacy Policy.
